My truck was hit by a car while parked in valet parking. The valet company was not driving the other car, it was a lady who tried to get around my truck because she did not want to use the valet. The valet company took her insurance information and wrote a report indicating what happened. I only have a few deep scratches on my bumper, but it is a new car and kind of want to get it fixed because it is new. I was hesitant to call my insurance and tell them about it because I have heard that a claim is a claim on my record regardless of fault. I did call my insurance to discuss the situation and when I could ask if my insurance would go up for a no fault claim, the lady told me she just filed the claim and an adjuster would contact me in a few days to answer all my questions. If it is only a few hundred dollars in damage, I would have rather paid it myself than have a claim. Background: My wife left me and is filing for divorce. She took her car which is a marital asset that both of us own. She has since left the state to move in with a friend and I cannot get a hold of her as she will not return my calls. Update: Our current auto coverage is set to expire on 10/17. My wife and I are in our 40's and 50's. We have created A/B trusts and transferred our assets to them, and expect to have estates that will benefit from the estate tax saving these trusts afford. We recently both purchased $1M 10-year renewable term life insurance policies that we expect to keep for 10 years. We chose not to use life insurance trusts because the purpose of the policies is to replace the lost income of the deceased spouse if one of us dies relatively soon, not to increase our final estate, and the trusts are somewhat costly. We each specified our own trusts as the beneficiaries, because we want the disposition of assets specified there to be used for this money. The trusts provide for the income, and principle if needed, to be paid to the spouse, and for the remainder to be paid to our child at the remaining spouses death. The question of ownership of the policies is less clear. My lawyer says that it doesn't make much difference who owns them, because the value (estate) taxed is only one year's premium, not the $1M. My accountant says that the $1M is taxed, and that each policy should be owned by the other spouse to avoid tax on that amount. A friend said that there's no way to avoid or significantly decrease the tax, so just leave the ownership as is (each spouse owns their own policy). A further fly in the ointment is that the insurance company (Massachusetts SBLI) makes some forms of trust ownership more difficult and costly. I'm confused. What ownership is the best? I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. Damage is to the rear bumper, pretty bad, looks horrible...especially for a new car! No one was hurt, just shaken! We did not immediately file a police report. We exchanged information, and the the person who hit me told me that they would pay for my repairs out of pocket, and that they didn't want to get the police or insurance involved. We conversed on the phone for a few days, and they seemed like everything was going great, and I was supposed to meet them at their friends auto body shop for the repairs...long story short...they never showed. Bad part now is, I never got their insurance information, just license plate, DL, addresses(basically everything BUT insurance). That same day, I went to the police station and filed a delayed police report. Later that week, I went and got 3 different estimates, and the damage averages out to about $900. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). But, what if they don't have the money? I have no idea what to do. I live in NJ, hope someone can help!

I was in a car accident last week, which wasn't my fault. The auto body shop said my car is totalled because of the damages, it can't get fixed. The other person's insurance is going to pay it off because of the loss, I have full coverage and my question is, can my insurance get my another car or do I have to get it myself? I know this is long but please bear with me. Rather than set up a separate government run medical insurance or expansion of medicare to the general public....One criticism of government care is that it will be in direct competition with existing providers. Ultimately siphoning insurance customers away from traditional plans and onto the rolls of govt care causing these providers to go out of business. Here in my state the auto insurance companies MUST offer the same basic minimum coverage in order to do business in the state. Everyone here must have at least the same basic level of insurance (both auto and medical) . You can go to any provider you choose and this basic minimum insurance level costs the same . If you want more insurance you can pay for additional coverage. But that basic plan is available to all. So why not have a similar program for medical insurance as part of a nation wide group policy. This group can be subsidized by the government but it would be managed by the existing insurance providers. (In other words if you want to be in the insurance business you must offer and support this minimum plan which would be a foundation for any other plan you offer) The govt pays the insurance company a flat rate to manage each person enrolled in the basic plan. The more money the company saves (the better they manage the insurance) the more money they keep. However if that company provides poor management it will cost them. Either subscribers will change management companies if they feel they are getting a raw deal or wasteful management would not be payed for by the government. One advantage I see here is that consumers would have an alternative providers to go to if they feel wronged by a particular management company. Insurance providers also have an incentive to offer additional services to the basic plan members in order to attract more subscribers and earn money. With a govt program like medicare your stuck with the one provider (the governement). As they say One Choice is NO Choice.... If someone wants additional insurance they can buy additional coverage from any provider they choose. But No one could be denied coverage for the standardized basic plan. Since everyone is part of this national group policy the basic insurance is portable and independent of supplemental policy one may have. So if you change jobs or move to a different state you may loose the supplemental policy BUT your basic coverage remains intact. You merely transfer the company that provides the management services for the basic medical. Insurance providers would get paid by the fed to manage the participants in the basic plan for each participant in the basic plan. this would put market forces into play for the insurance providers to make money by attracting additional participants through better service or offerings. COunter to this is if the consumer gets crappy management services they can transfer to any other insurance provider.

Lots of info, sorry! My car was parked on the street and hit during the night. I drove the car to the repair place the following morning and the airbag deployed on the way there. (Stupid, I know, I wasn't thinking). My insurance company, GEICO is insisting that the damage is not consistent with a hit and run accident. They have taken recorded statements from me and my boyfriend. They have contracted an independent accident reconstructionist to read the airbag deployment. The reconstructionist originally told me that he was unable to retrieve the data, but the insurance company is now telling me that he was able to get a partial reading. And that it shows that the airbag deployed as a result of impact. The airbag did not actually fully deploy. There is no powder or injury to me to justify a complete deployment. Does anybody know if they have the right to deny my claim based on suspicion? They keep trying to make me say that my boyfriend was driving the car, which he wasn't. We were in the house together all night. Also: car was in previous fire; severe damage to front of car, all repaired. accident happened in CA, full coverage policy written in GA I know its a lot of info. My fiances insurance is OUTRAGEOUS on a truck he has liability only on ..due to his driving history. Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Do you have any recommendations for lawyers who would be willing to take on property damage lawsuits? What are my options?

Advice for health insurance please? (community college student with low-paying part-time job)?

I haven't had health insurance since I turned 18 and no longer qualified for my family's health insurance plan. I wasn't really concerned at the time, but now that its been a few years (I am almost 21 now), I am in need of dental care. My problem is that I don't know what my health insurance options currently are. I am a college student, although my community college does not offer any health plans for students. I do have a part time job at a daycare that offers health insurance, however its price is far too high for my income. The insurance company is Aetna, and would cost me $16.92 for the lowest medical option, plus $4.61 for dental. So that would cost me $21.53 weekly, which doesn't sound too bad, except I only earn about $120 every two weeks....reducing my paychecks to about only $76 every two weeks....which just isn't enough for me to live on considering that I pay for my own food and everything else needed. So.... does anyone know of health insurance companies that have options for community college students like me? I know state insurance may be an option, but I have a feeling I don't qualify for that since I'm not legally an independent, yet I can't afford to move out and become independent. See the nasty cycle now? lol. And no, earning more money and finding a better paying job is not an option for me at this time. I can't transfer to a college that does offer health insurance for another two years either.. If anyone can give me advice, I'd be very grateful. Thank you in advance =)

Before you answer, please read this thoroughly. I am a student and Illinois Resident. I have PPO health insurance in Illinois that I pay out of pocket for. $1000 deductible, 100% covered. I go to school in Florida and have employer insurance in FL (ever since Sept 2008), but it's an HMO. The PPO my job offers has no deductible but is 80/20 coverage, so I opted the HMO. For the average person, it would make no sense to have 2 policies, but I'm not ordinary. I have many pre-existing conditions (some I was born with), hence the Illinois coverage. In Dec of last year, before my FL insurance kicked in, I had a multitude of issues which caused me to have to use my BCBS of IL in Florida where I'm attending school. Many of those things are at bay now, but for doctor visits, exams, etc to arise other than routine check ups, should I start using my FL HMO insurance and just use my IL insurance for when I visit home during breaks? Or should I just drop my FL insurance altogether? The reason this is an issue is b/c I am afraid I my rates will go up or they drop me if I continue to use my insurance which was meant to be for IL, but I have been using it in another state. Yes they will cover b/c it's PPO and it falls under the BCBS umbrella, but this is the risk I take. I will NOT drop my Illinois insurance because I have pre-existing issues that is NOT covered by my FL insurance, so switching isn't even on option. Plus they keep doing layoffs and my certainty at this job isn't guaranteed. Furthermore, I keep reading about fraud, this is not my intent. I am just trying not to have my rates rise anymore b/c I am a student and not making much as it is. I am looking for the best coverage because good health care is my primary concern. I am NOT trying to file a double claim with both insurances, and I am NOT trying to collect any money out of this. Things happen like the flu, ER visits, and any other reason to visit the doctor when you are sick or injured. I have a 2 week window during open enrollment to drop my coverage thru my job. I pay only $20 per paycheck for my FL HMO insurance. So the little amount really isn't that much to fret over, but I need to know b/c I don't want my IL insurance to go up or to be denied covereage b/c I have two policies out there. So, here is my predicament. A person wrecked into my car (while it was parked) and her Insurance Company (State Farm) has already sent out a person to do estimates and told me it is a Total Loss, which is fine, they offered me a lot more then blue book says, BUT my issue at the moment is, they told me I need to get my registration up to date before they would deal with me anymore (Was expired by a month cause my lack of insurance). So I rode up to a Tag Agency and got a Black Tag (In Oklahoma, we have color coated Registration stickers that we put on our License Plate) A Black Tag means it is not being driven and is parked but is up to date on being registered. So they told me they would call me back when it shows in their system I have registered my tags to up-to-date, and I called them today, which was over 48 hours after getting registration and they are still telling me they haven't heard anything. I got pulled over for speeding. i have no insurance but i have my motorcycle permit and my driving license. when he pulled me over he asked for my license and of course, i didnt have it. it was in my jacket and i didnt wear it. i had my permit for my bike though. gave him that and my registration. he asked for my insurance, and i knew i didnt have it. but i looked through my backpack and under the rear seat. so when he gave me the ticket he said that the no insurance and license was just a fix it ticket and to take it into the court and show them and they will sign it of and the other is speeding. when i looked at the ticket when i got home, in the part where they rite down if it can be corrected or not the license says yes and the insurance says no. my question is, if i buy insurance now and go in and show them that with the license will they sign it off. or what will they do if i dont have insurance? also the reason i dont have insurance is i dont have the funds to buy it. i just want an answer to my question please not a lecture. thank you

Auto insurance question - I hit a big pothole..?

Saturday night I hit a big pothole and a few miles later my tire was completely flat and actually had holes big enough to stick a few fingers through. I took it to a tire repair shop and the rim was bent as a result of the tire going flat. They've found a replacement rim, but it doesn't match the other 3 on the car.. I would like all matching rims, but a complete set with tires is about $800. Would something like this be covered by auto insurance? The cost of the mismatched replacement rim and 2 new tires is $350, my comprehensive deductible is $500, but I would pay the $500 if insurance covered 4 MATCHING rims.. So basically I'm wondering: 1) Is this something auto insurance would cover? 2) Would they just cover any replacement rim, even if it didn't match the other 3 or 3) Would they pay for a whole new set of rims? If anyone worked for an insurance company and might know the answer that would be great..

Hi, I'm 16 years old and I currently have a 2002 Gmc Envoy, and I love the qualities of the car, but the brakes are horrible and it's crash test rating is really low. I've had people pull out in front of me on more than 2 occasions and my brakes take so long for the car to stop so im really nervous when driving it. I want to trade it in and get a 2000-2005 ford expedition because its on the same platform as my dads f-150 and when I drive his truck the brakes are so much better and I have better visibilty, the expedition is also better in crashes. I know the gas is more but it only gets 2 miles less than my envoy and I only use if to drive to school and footballs games. If i were to switch cars how much would my monthly incurance be? Im 16 and im a honor student so I do get a discount with farmers insurance. Also i believe right now my envoy is pricey because its the high class edition with the heated seats and stuff so all of that makes the rate higher. I currently live in South Carolina and I'm in need of a particular surgical procedure, and my current insurance provider rules the surgery as cosmetic when in fact, an orthodontist, dentist, and an oral surgeon all suggested that surgery is a good option for me. They've all told me the same thing, however, that the surgery is difficult to get approved. So I did a bit of research and only one insurance company in the entire United States covers the procedure (That I could find). But, this insurance (Kaiser Permanente) isn't offered in my state. It is however offered in Georgia, which is relatively close. So my question is, could I switch to Kaiser Permanente if I don't live in Georgia, California, or one of their other locations? Points reduction DD course. Option 1 seem to be at the discretion at the auto insurance company but does option 2 also have an affect on insurance? False County Court Claim Against Me on My Car Insurance?

Someone has put a claim in against me for damages, for an accident I know nothing about. It is from early 2010 and has been going on since then. I have been contesting it on the grounds I have not been involved in an incident, however the third party solicitors have issued County Court proceedings against me. My insurance company are saying they are putting in a defence and have provided a barrister. I am really annoyed with this as I know I haven't been in an accident. I could understand if maybe they were claiming I clipped them and I had done it without realising but they are claiming for an accident which I have no knowledge of! I have attended the Magistrate's Court hearing and although I pleaded not guilty I have been found guilty on the grounds that for the time and date of the accident I have no alibi, witness or other evidence to support my whereabouts. The other party has an independent witness who works for the same company and alleges she could recognise my car but not me as a driver. Mag court fined me and gave me 6 points on my licence. I am not working (and not in receipt of any benefits) and this CC claim amounts to 5k! How would I pay a sum like this??? Or would my insurance company pay out if I was found to be at fault ??? I took the following two courses during high school and was just wondering if car insurance companies accept both courses as a student discount or will they only accept one? -->I paid and took for the Driver's Education course with my high school. -->I later took a free course called the Defensive Driving Courses - Alive at 25 . Are both accepted into my policy for discount or only one?

Our car (or my husbands car you might say) is legally my father-in-law's because its registered in his name. My husband's car insurance is also under his father, but his name is on his father's insurance policy. Question about car insurance.?

my dad has never been in a car accident or anything of the sort. 4 months ago we got a 2005 dodge ram rumble bee. i was really confident about my driving. but today i was exiting on a freeway and the car in front of me stepped on the brake real hard and i had no choice but to swerve outside the lane. i didnt hit anything else but the bottom of the front bumper kinda got wrecked and bent. i didnt hit the car in front of me or anyone else and i gained control of the truck and slowly got back on the lane. so if my dad reports it to the insurance how much will it go up?? he told me not to speak of this to anyone and he was gonna say it was him that it happened to. please help. what if i replace the bumper and dont report it? should i even report it?

Hi, I've got a general question about car insurance companies. Do companies really charge more to insure a 2 door car versus a 4 door car? I understand the whole 2 door=sports car theory, but not every two door is sporty. Does it really make that much difference? For instance, there's a 2001 Chevy Cavalier 2 door in my local newspaper for $2500. Would my parents pay more for insurance coverage on it than if it was a 4 door Cavalier? USAA insurance rates from traffic ticket?

I received a traffic ticket for following too closely and was clocked at 17mph going through town. The car in front of me had pulled away from the stoplight and was clearly not interested in speeding up, so I had to speed up some to signal into the adjoining lane to pass him. This was during rush hour, so traffic was pretty heavy. The cop pulled me over and cited me for following too closely which carries a $115 fine. He asked me why I thought he pulled me over, and I honestly had no idea what I did wrong. Unfortunately, he would not concede to a simple warning and cited me anyway. I also received a ticket about 11 months ago for not coming to a complete stop at a stop sign before turning. USAA did not increase my rates from this ticket, but I am concerned that they might increase my rates if they find out about the latest ticket. Should I plead not guilty and have a trial date set to fight this, or just pay the fine and pray that USAA doesn't pick it up? Does anyone else have experience with two minor traffic violations within one year and USAA auto rates?
